Sometimes the parties or the Judge assigned to the Divorce case appoint a mediator to resolve the issues. Divorce mediation is an alternative dispute resolution process, which means, in short, that couples resolve all of the issues between them without involving a court hearing. One of the benefits is that both parties can resolve the issues without testifying against the other party. Especially when there are children this helps to keep anger to a minimum. I have had many cases that I would have bet would not resolve in the mediation process successfully resolve. Sometime all of the issues can not be resolved but a majority can be this reduces the trial time necessary to bring the matter to a close.
Normally the mediator is an attorney selected by the parties, but the Judge can make the appointment without consulting the parties. Also, in domestic relations cases the mediator does not always have to be a mediator
The goal is to reach an agreement will become the marital dissolution agreement upon which the divorce is granted, if the agreement is approved by the court.
The final agreement is prepared by the mediator. Then the agreement is submitted to the parties for review and finally to the court for approval.
My client enjoy the fact that the case is disposed of quicker and with a lower fee than those case that must go to trial.
